Terms of Service

These Terms of Service ("Terms") govern your use of Filtro (the "App"), operated by EZ RECURRING LLC ("we", "our", or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

The App provides AI-powered image generation and processing. You may upload images and receive AI-generated images based on your input. The App does not require account creation.

2. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Subscriptions & Payments

The App may offer premium features through in-app subscriptions (monthly or annual). Subscriptions are processed and billed by Apple through the App Store.

• You may cancel your subscription at any time through your iOS Settings.
• Refunds are handled in accordance with Apple's App Store refund policies.
• We do not directly collect or store your payment information. Subscription management is handled through RevenueCat.

4. User Conduct

By using the App, you agree not to:

• Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Use the App to create content that infringes on the intellectual property rights of any third party.
• Use the App to generate deepfakes, non-consensual intimate imagery, or content intended to deceive, harass, or harm others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the App.
• Use the App in any way that could damage, disable, or impair the service or interfere with other users.
• Use automated scripts, bots, or other means to access the App outside of its intended use.
• Circumvent, disable, or otherwise interfere with any security or access control features of the App.

We reserve the right to restrict or terminate access to the App for any user who violates these Terms.

5. Image Content & Usage

Your uploads: You retain ownership of images you upload to the App. By uploading, you grant us a limited, non-exclusive, royalty-free license to process your images solely for the purpose of providing the service (AI image generation).

Generated images: Images generated by the App are provided for your personal and commercial use, subject to these Terms.

Data retention: All uploaded and generated images are automatically deleted from our servers after 30 days.

No guarantees: We do not guarantee the accuracy, quality, or suitability of any AI-generated content. Results may vary.

6. Intellectual Property

The App, including its design, code, branding, and all associated content (excluding user-uploaded and user-generated images), is the property of EZ RECURRING LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

7. Disclaimer of Warranties

The App is provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties, express or implied, regarding:

• The accuracy, reliability, or quality of AI-generated content.
• Uninterrupted or error-free operation of the App.
• The App being free of viruses or harmful components.
• Fitness for a particular purpose or non-infringement.

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EZ RECURRING LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App's subscription in the six (6) months preceding the claim, or $0 if you have not made any payments.

This limitation does not apply to claims arising from gross negligence or willful misconduct.

9. Indemnification

You agree to indemnify and hold harmless EZ RECURRING LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Content you upload or generate using the App.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.

10. Dispute Resolution

Informal Resolution: Before filing any formal legal action, you agree to contact us at team@ezr.llc and attempt to resolve the dispute informally within 30 days.

Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in the State of California. You agree to waive any right to a jury trial and to participate in class action lawsuits.

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, cyberattacks, government actions, or infrastructure outages.

14. Changes to These Terms

We may update these Terms at any time. Changes will be posted with a new effective date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
